Terms & Conditions

1. Competition Promoter
   1. The Big Al’s UK competition is organised by Big Al’s UK, a trading name of Kepak Convenience Foods, a UK establishment registered in England and Wales with establishment number BR018242, and whose UK establishment office is at The Snackhouse, St Georges Park, Kirkham, Preston PR4 2DZ (‘Kepak’).
2. The Competition
   1. The title of the competition is ‘Big Al’s UK National Burger Day Competition – Win A Year’s Supply of 4oz Beef Burgers’ (the ‘Competition’).
   2. This Competition is open to legal residents of the United Kingdom (excluding Northern Ireland), aged 18 years or over, or anyone who operates a business within the United Kingdom (each an ‘Entrant’). Only one Entrant shall be selected from the Competition to win the Prize (as defined in clause 5.1), in accordance with the terms in clause 5.
   3. On entering the Competition, each Entrant agrees to be bound by these competition terms and conditions (the ‘Terms’).
3. How to Enter
   1. No purchase fee is necessary to enter the Competition or to receive the Prize.
   2. The Competition shall begin from 09:00am on 26 July 2024, and ends at 11:59pm on 31 August 2024 (the ‘Closing Date’) (this period being the ‘Competition Period’).
   3. To enter the Competition, Entrants must complete an entry form (‘Form’), which can be found at https://www.kepakfoodservice.com/national-burger-day-competition/ (the ‘Website’) or by submitting the Form via Facebook and/or Instagram. The Form must be completed in full by an eligible Entrant.
   4. It is the responsibility of the Entrant to provide correct, up-to-date, and accurate details when submitting the Form. Kepak cannot be held responsible for Entrants failing to supply accurate information. Where Kepak is aware that any information contained within a relevant form (either on or after the Closing Date) does not comply with these Terms, Kepak reserves the right, at its absolute discretion, to reject the contents of the Form, and in which case the Entrant will no longer be eligible to enter (or remain in) the Competition.
   5. Kepak will not accept:
      1. responsibility for Competition entries that are delayed in transmission regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      2. proof of transmission as proof of receipt of entry to the Competition.

4. Eligibility
   1. This Competition is open to legal residents of and businesses registered in the United Kingdom (excluding Northern Ireland) only. By entering the Competition on behalf of a business, the authorised representative of that Entrant confirms that it is duly authorised to enter into the Competition for and on behalf of the Entrant.
   2. The following individuals are not authorised to enter the Competition:
      1. employees of Kepak or its holding or subsidiary companies or any subsidiary of a holding company including its affiliates, employees of agents or suppliers of Kepak, any advertising and promotion agencies and suppliers (collectively the “Employees”); or
      2. employees of agents or suppliers of Kepak or its holding or subsidiary companies who are professionally connected with the Competition or its administration.
   3. In entering the Competition on behalf of a business, the Entrant confirms that it is a registered business and that it is eligible to claim the Prize. Kepak may require the Entrant to provide proof of its registered status and identification of any authorised representatives to ensure compliance with these Terms.
   4. There is a limit of only one entry per Entrant.
5. Prize
   1. The prize for the Competition is a year’s supply of Big Al’s Flame cooked 4oz beef burgers up to the value of £1000.00 (‘Prize’). There is one (1) Prize available to be won by a successful Entrant (the ‘Winner’).
   2. The Prize is non-negotiable or transferable and there is no cash or other alternatives for the Prize.
   3. Kepak reserves the right to substitute or replace the Prize with an alternative prize of equivalent value or higher value if circumstances beyond Kepak’s control make it necessary to do so and without giving prior written notice to any Entrant or the Winner.
6. Winner Selection and Notification
   1. The Winner will be chosen by random selection on 05 September 2024 (‘Selection Date’) to be made by Kepak from all eligible entries received during the Competition Period.
   2. The decision of Kepak (acting reasonably and save in the event of manifest error) as to the Winner will be final and no correspondence or discussion will be entered into with unsuccessful Entrants.
   3. The Winner will be notified via the contact details provided on the Form within 5 working days of the Selection Date.
   4. Kepak will make all reasonable efforts to contact the Winner but if the Winner cannot be contacted or does not notify Kepak in writing to claim the Prize within 10 working days of notification provided in accordance with clause 6.3, Kepak reserves the right to offer the Prize to the next eligible Entrant selected from the correct entries that were received before the Closing Date.
7. Delivery of Prize
   1. The Prize may not be claimed by a third party on the Entrant’s behalf.
   2. The Prize will be fulfilled to the Winner via an existing wholesaler of Kepak Big Al’s Burger range (‘Existing Wholesaler’) and the Existing Wholesaler will be determined by Kepak following the Selection Date of the Winner. Within 30 days from the Winner claiming the Prize in accordance with clause 6.4, Kepak will agree the fulfillment details of the Prize with the Existing Wholesaler in writing. The Winner will be able to purchase orders from the Existing Wholesaler identified for either a one year period or until any credit note (where applicable) has been exhausted in its entirety, whichever is earlier.
   3. Kepak is not responsible for any delays or issues with the collection or delivery of the Prize by any Existing Wholesaler, however arising.
8. Limitation of Liability
   1. Insofar as is permitted by law, Kepak, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of entry into the Competition or taking up the Prize except where it is caused by the negligence of Kepak, its agents or distributors or that of their employees.
9. Data Protection and Publicity
   1. Kepak will only process personal information as set out in its Privacy Policy which can be found at https://www.kepak.com/docs/privacy-policy/.
   2. By entering the Competition, the submitting individual agrees that any personal information provided by it within the Form may be held and used only by Kepak or its agents and suppliers to administer the Competition.
   3. Entrants will be invited to opt in to receiving marketing from Kepak (operating under the Big Al trading name or any of its other trading names). If Entrants choose to opt in, their details will be retained by Kepak for the purposes of marketing (which may include activities such as passing on information about deals, offers and promotion codes from Kepak).
   4. Kepak must either publish or make available information that indicates that an Entrant has been successful in the Competition and may use any information submitted in the Form for these purposes.
   5. If an Entrant objects to any or all of its information being published or made available by Kepak, it shall contact Kepak at info@kepak.com. In such circumstances, Kepak must still provide the information and winning entry to the Advertising Standards Authority on request.
   6. On acceptance of these Terms, the Entrant further agrees to participate in any reasonable publicity and marketing promotions required by Kepak.
10. General
    1. Kepak reserves the right to cancel, terminate, modify or suspend the Competition without liability (howsoever caused) at its absolute discretion, or in the event of any unforeseen circumstances or technical issues.
    2. Kepak reserves the right to disqualify any Entrant who tampers with the entry process or violates these Terms.
    3. By participating in the Competition, Entrants agree to be bound by these Terms and the decisions of Kepak, which are final and binding in all respects.
    4. If there is any reason to believe that there has been a breach of these Terms, Kepak may, at its sole discretion, reserve the right to exclude the Entrant from participating in the Competition (or any future competitions, as the case may be).
    5. Kepak reserves the right, without liability, to hold, void, suspend, cancel or amend the Competition where it becomes necessary to do so. Kepak shall not be liable for any loss of profit, loss of business, loss of business opportunity, or any other losses (whether direct or indirect) (Losses), which may arise out of or in connection with the Competition (or any amendments, suspensions or cancellations) as permitted in these Terms.
    6. These Terms shall be governed and construed in accordance with the laws of England and Wales and the parties submit to the exclusive jurisdiction of the courts of England and Wales in connection with any claim arising under or in connection with them.
